RésuméCe travail tente de cerner les mécanismes de participation de l’administration au processus de production des règles de droit. Cette manifestation particulière du pouvoir bureaucratique paraît contraire aux principes fondateurs de la Révolution française, lesquels niaient l’existence d’un pouvoir administratif autonome. Pourtant l’administration semble jouer un double jeu institutionnel, d’abord par son rôle officiel d’exécution et d’application de la loi, ensuite par son activité semi-clandestine de producteur de norme. Un tel clivage heurte un système institutionnel qui tend à privilégier la séparation des pouvoirs et faire participer la nation à l’élaboration de la loi. À travers l’étude des archives de l’administration des Beaux-Arts sous la IIIe République, cette étude tente de donner des réponses concrètes à ces observations.

The Preparation of the Legal Rules during the Interwar PeriodThis article attempts to understand the mechanisms of the administration’s participation in the process of creating legal rules. This particular demonstration of bureaucratic power appears contrary to the founding principles of the French Revolution, which denied the existence of an autonomous administrative power. And yet the administration seems to play an institutional double game: first by its official role of execution and application of the law, and second by its producer’s semi-secret activity as the creator of norms. Such a cleavage strikes an institutional system which tends to privilege the separation of powers and to make the nation participate in the elaboration of the law. Drawing on the archives of the administration of Fine Arts under the 3rd Republic, this study tries to offer concrete answers to these observations.
