Cet article analyse le système roumain de justice pour mineurs à une période marquée par la réapparition de réponses punitives à la délinquance juvénile en Europe. En Roumanie, l’implantation et le respect des droits des enfants en conflit avec la loi pénale en visant principalement la protection et en évitant la sur-criminalisation du traitement des enfants en conflit avec la loi pénale, ont eu une influence bénéfique. Les conclusions de l’analyse soulignent que le système roumain se positionne aujourd’hui entre sanction et réhabilitation, entre tradition Welfare et inflexions néolibérales.

The present paper examined where Romanian juvenile justice system stands in a time dominated by the re-emergence of the punitive answers to the juvenile crime and delinquency. The results of the analysis indicate that compared to other European and non-euro-pean systems, in Romania, the observance of the Human rights of the children in conflict with criminal law has been beneficial aiming mainly at (legal) protection as well as at avoiding the over-criminalization’of the treatment of children in conflict with penal law. The conclusions of the paper emphasize that the Romanian Juvenile Justice System stands between retribution and rehabilitation, between the welfare tradition and the neo-liberal tendencies.
