The new procedure for divorce by mutual consent without passing before a judge marks a move towards the contractualisation of family relationships. While lawyers do already have a certain number of tools at their disposal to enable the parties to find solutions to settle their disputes and contribute to calming the situation, the collaborative process and participatory procedure will be decisive to the success of this reform. In this respect, the dejudicialisation of divorce is largely in the hands of the lawyers.
