The Law on Khul’ in Egypt. Argumentative Constraints and Reforms of Family Law.

This contribution proposes, through an analysis of the adoption of the khul’ law in Egypt (2000) and its implementation by courts, to study the processes of legitimation that the Egyptian authorities have used to justify the adoption of this reform in the Egyptian legal system. This paper also shows how feminist NGOs have finally accepted to place themselves on the religious field in order to anchor their struggle for the adoption of new family law reforms. Finally, it reveals how trial courts who rule on divorce applications for khul‘ also very often refer to Islamic law, but without questioning the quite bold interpretation adopted by the legislator.
