The algorithmic puppet or the omniabsence of the “justiciable” in the digitalisation of the justice system

If the figure of the “justiciable” – the parties involved in proceedings, often meaning the accused – is a common one in French legal discourse, it is being mobilised in a particular way in connection with a topic that is particular itself: the digitalisation of the justice system. Although this figure is only an indirect target of most of the objects studied in connection with this topic, it is nonetheless frequently referred to in support of the analyses being made. Serving in turn as a rhetorical tool and a convenient pretext, the justiciable appears in the end, in the face of a digitalisation of the justice system that has no interest in him or her, as eternally omniabsent from the discourse that sets out to analyse him or her.
