The French law of 2 August 2021 on bioethics changed the legal framework for medically assisted reproduction with third-party donors in a quite significant way without, however, breaking with fundamental ethical principles. Under it, couples of women and single unmarried women can benefit from sperm donation, self-preservation of gametes without a medical reason is authorised and access to information on the donor (without disclosure of their identity) has been arranged for persons conceived from a gamete donation. However, these major developments should not mask the many uncertainties that remain regarding the use of gametes within a couple – when the couple is made up of two women or a trans person – or regarding more general access to MAP for people who have changed their sex under their civil status.
