In the fight against terrorism, the acceleration of procedures and the modification of judicial systems give a prominent place to the safe design of emergency measures. Through the analysis of two appeals for misuse of power against administrative measures, taken to prevent “offenses against public order,” we study the ways in which procedural constraints on the French anti-terrorism system frame the development of the preventive reasoning. Developed by the agents in charge of surveillance, this reasoning is pre-fabricated prior to the referral of cases by judicial authorities, while being constantly subject to discussion during the development of litigation. In this reasoning, the security imperative takes precedence over protecting fundamental rights and freedoms.
