Disobedience, right, and duty: A constant topic for half a century

The general statute of soldiers was rewritten in 2005. The press announced it, believing itself obliged to point out a provision that was presented as a major new change: from now on, soldiers’ right, or even duty, to disobey would be recognized. Yet, as the author shows, these provisions appeared as early as 1966, with the regulation on general discipline that took the place of that of 1933. They were confirmed by the general statute of soldiers of 1972, in terms that the new text of 2005 merely reconfirmed.
