Since 2011, a judge, the guardian of individual liberty under section 66 of the French Constitution, must hold a hearing for patients who have been placed in psychiatric hospitals without their prior consent, within a period of twelve days. This conversation should cover the issue of confinement and restraint if they have been used. If the patient does not attend the hearing, this should prompt the judge to ask after the reasons why it was impossible to have this encounter and to hear from he or she whose freedom has been curtailed in order to protect their health.
