The search for freedom in psychiatric care: From equipotentiality of care to care programs

Although the aims of public health and social order are clearly laid down within the field of mental health, the issue of the freedom of choice of the mentally ill person remains open to discussion. And indeed, freedom lies at the heart of any ethical reflection on psychiatric care. The reform of French mental health legislation concerning care programs (July 5, 2011 and September 27, 2013) sum up the critical questions at stake in this process. It is a question of understanding whether or not this legal model of outpatient care without consent leads to beneficial care outcomes, and whether it enables the patient to make their way towards free and elective care.
