The weaponization of litigation to kill Obamacare in the name of religious freedom

Ressources en ligne : Abrégé : This paper shows that litigation has become a normal way to continue a lost political battle and that Republicans have resorted to it on many occasions to challenge various provisions of the ACA in an effort to destroy it. It explains the arguments put forward: violation of the Constitution, infringement on religious liberty or violation of the law. It also sheds light on the role of amici curiae, those outside groups that are not directly parties to the litigation but play a very important role in pushing their vision of the case or their interpretation of the law or the Constitution. A special emphasis is placed on the latest Obamacare Supreme Court decision in which the Justices ruled that the plaintiffs did not have standing to challenge the law. This is yet another example of the large discretionary power enjoyed by the Court and of the risks for health care and other liberal achievements now that the Court has a majority of six conservative Justices and abandons judicial restraint when this proves convenient. Hence the various proposals to change the number of its members or limit its powers of judicial review.
