As soon as the priority preliminary ruling on the issue of constitutionality was implemented, the Court of Cassation expressed its distrust. Its first rulings express the reluctance of the civil magistrates to admit the right to control an existing law. They also testify to the fact that, on the whole, the Court of Cassation sees the priority preliminary ruling on the issue of constitutionality as a sort of competition, all the more unwelcomed as the Constitutional Council does not have the same legitimacy as the Court. The hostile signals of the Court of Cassation have in turn prompted strong, even brutal, reactions. In this respect, 2010 will remain a year of unprecedented institutional rifts and of doctrinal and praetorian disputes, to the risk of a genuine breach between the Court of Cassation, part of the doctrine, the Constitutional Council and Parliament.
