The European Court of Justice as a Core Element of European Governance

The European Court of Justice has played a crucial role in the process of European integration. In this paper, the authors question the argument that after years of jurisprudential activism the Court might have begun an exercise of self-restraint since the 1992 Maastricht Treaty. Yet, if one analyzes the Court within the broader framework of the European Union political system, one can see that it remains extremely active in certain areas, in particular the defense of fundamental rights.
