The United States political structure is founded on a system of “checks and balances” that is supposed to limit the powers of the president. However, Congress, the first counter-power, has been inactive for two years and remains powerless, despite the Democratic majority in the House of Representatives since the beginning of 2019. Resistance has therefore come from certain components of the executive, the states, civil society, various public interest groups and companies. To build their resistance, they have all opted for litigation before federal courts.
