The Juridical Status of Prisoners in Belgium: An Illustration of the Consequences of the Articulation of the Powers of Sovereignty and Normalization

In Belgium, juridical status is ensured to inmates through law. This paper attempts to analyse this juridical status through the lens of Foucauldian concepts of "sovereignty" and "normalization". We argue that in order to bring about positive outcomes, such a status should escape the risk of an "over-coding" that articulates in a cumulative fashion both powers of sovereignty and normalization. Contrarily to the very aim of providing a juridical status, an over-coded status would indeed certainly worsen inmates' situation.
