Paying for surrogacy: Contexts, issues, limitations

Paying for surrogacy would seem incongruous in France, where the practice remains prohibited by law. Elsewhere in the world it has developed in two main forms: “altruistic” surrogacy, where the surrogate just receives compensation; and “commercial” surrogacy, where she obtains remuneration. Surrogacy is however seldom conceived of as a kind of work, although such a conceptualization would contribute, from a feminist perspective, to combatting the exploitation of surrogates. But even if fair, payment remains insufficient: a protective framework is also needed that would be supportive of other forms of recognition of their work.
