The aim of this article is to analyze the contribution of court rulings on the respect of equal pay over a 25-year period in France, regardless of gender. The aim is to understand what type of equality is emphasized by judges. The judicial approach highlights the link between formal equality and real equality by appealing to the principle of equity, which influences managerial policies on salaries within organizations.
