Law and animals: The signs of a legal post-humanism

Par : Type de matériel : TexteTexteLangue : français Détails de publication : 2020. Ressources en ligne : Abrégé : In recent years, the law seems to have been marked by an “animalist turn”, revealing a growing sensitivity towards living creatures. Whether through legislation or litigation, the law is blurring the boundaries of the summa divisio that it used to place between persons and things. Thus, animals, and even Nature as a whole, are sometimes recognized as subjects of law. This article will shed light on the anthropological and normative presuppositions accompanying the recent legal strategies deployed by various actors to protect animals. Our investigation aims to identify the different ways in which the law has come to grasp the relationship between humans and animals and thus to identify possible signs of a shift towards a post-humanist paradigm.
