Jurisprudence in Management: the Determining Factor for Links between the Organisation of Work and Mental Health

This question is approached from the perspective of legal principles applied by judicial review judges (jurisprudence of the Cour de cassation), as well as considering the solutions proposed by appeal court judges (jurisprudence of the Cour d’appel). Using the Snecma jurisprudence from 2008, the analysis examines certain civil disputes in which the judges review management practices with regard to their impact on the mental health of employees. Two dispute cases have been taken as examples : one related to the employer’s safety-related obligations and the other concerning the prerogatives of staff representatives. They make it possible to illustrate how jurisprudence contributes to regulating the protection of employee mental health and therefore, in law, management appears to be a determining factor in the links between the organisation of work and mental health.
