The Interinstitutional Dimension of Regulatory Impact Assessment in the European Union at the Age of Smart Regulation

The institutionalization of the regulatory impact assessment in the European Union enabled to improve decision-making. Inconsistencies are revealed due to an excessive centralism in the design and conduct of the tool. This results from the European commission voluntarism and from the Parliament and Council procrastination. An opportune awakening can be noticed from those institutions towards administrative tool. However, this tool needs to be properly justified in order to avoid others inconsistencies. Therefore, a new interinstitutional agreement, in particular on cooperation of the institutions in their pre-decision-making behaviors, become pressing.
