Modernizing a « Modern » Law. Simplification Policy’s Backgrounds and Meanings in the Environmental Field

As part of the French simplification policy, environmental law is more and more questioned, to the point that some actors have warned of a risk of environment protection’s decline. Distinguishing two main stages (60’s-2010; 2010-2015), the article traces the trajectories of two concerns : rationalization of public action on the one hand, and environment on the other hand. As environmental law is relatively recent, the need for modernisation is questionable.
