The Quality of Administrative Justice and Applications Filed by Foreigners

There has been a sharp increase in the number of actions filed by foreign nationals. The ability of the administrative justice system to “control flows” without increasing “resources” has become the essential criterion for assessing the “quality” of administrative justice. The regulation of actions filed is thus a symbolic reflection of the attempt to regulate migration flows: in both cases we can see the same obsession with figures, against which the effectiveness of a policy or reform is measured. However, this purely quantitative approach is contradictory to the requirement for justice and it disregards the judge’s protective function under the rule of law.
