The German Constitutional Court and the foreign policy of the FRG: some considerations
Type de matériel :
63
Created to defend the fundamental rights of Germans in the aftermath of the National Socialist experience, the German Constitutional Court interferes with German foreign policy through its judgments. It is particularly vigilant in terms of European construction, the intervention of troops outside the national territory, and the ratification of the main international treaties. Through its interventions in each of these sectors, it aims to protect the prerogatives of the Bundestag as trustee of the democratic legitimacy of the German nation. This approach provides the framework within which the government can conduct its foreign policy.
