Brief reflections on restorative justice and recidivism: Clarifying the possible confusion with the place of CoSAs in France

The law of August 15, 2014, introduced restorative justice in France as a criminal law measure available at all stages of criminal justice. However, placed as a criminological measure within the criminal justice system, a shift toward the goal of preventing recidivism is possible. Confusion may arise with the circle of support and accountability (CoSA), one of the modalities within restorative justice measures. We will also look briefly at the traditional modalities of restorative justice and CoSAs, the benefits and limitations, and the links and possible confusions around the question of the reduction of recidivism. We will conclude by discussing the distinction and links between rehabilitation and restoration.
