Le procès en cour d’assises, entièrement oral et contradictoire, permet d’éclairer l’acte, dont les circonstances et motivations deviennent alors plus complexes. La circulation de la parole sur cet acte humanise son auteur qui, de ce fait, réintègre le lien social. Cet éclairage total conduit à la reconnaissance mutuelle des uns et des autres et permet d’instituer la justice comme reconstructrice.

The dismay aroused by monstrous acts hides any reflection. The trial in criminal court, that is completely oral and contradictory, allows enlightening the act, of which circumstances and motivations become more complex afterwards. Oral circulation of this act humanizes its author who, therefore, reinstates the social link. This total illumination leads to the mutual recognition of one another and allows establishing justice as reconstructive.
