La recherche du consentement des malades âgés répond aux mêmes exigences que celui des autres patients. Cependant, la fréquence des difficultés de communication verbale, des situations dans lesquelles la personne a perdu son autonomie nous oblige à réfléchir sur les moyens de dispenser une information loyale, intelligible et adaptée préalable à tout consentement. La référence à des principes juridiques et philosophiques n’est pas suffisante et probablement réductrice et ne nous dispense pas d’aller plus loin dans la réflexion afin de garantir au mieux la dignité des patients fragiles, majoritaires dans les institutions gériatriques.

THE WHY-FOR OF CONSENT In seeking the consent of elderly patients the same rigorous standards must be applied as for any other kind of patient. However, frequent difficulties in verbal communication, cases where patients have lost their autonomy, make us reflect on the means of dispensing reliable and intelligible information which has been pre-adapted to all expressions of consent. The applying of legal and philosophical principles is not sufficient and is probably over-simplistic and does not mean that we shouldn’t reflect further on the ways of best ensuring the dignity of vulnerable patients who are in the majority in geriatric institutions.
