Des locaux ou des espaces peuvent être organisés pour accueillir les fumeurs. La vie en collectivité présente des avantages et quelques inconvénients et notamment celui de ne pas imposer à ses proches voisin(e)s tel ou tel aléa. La liberté de choix permet à chacun (âgé ou plus jeune, résident ou membre du personnel) d’opter pour telle ou telle attitude: fumer ou non ; cette liberté devrait s’accompagner d’une notion de responsabilité. Ainsi, peut-on accorder une priorité aux droits à finalité sociale ou aux droits individuels ou bien tantôt primer une norme plutôt qu’une autre, au gré des circonstances. En tous les cas, l’acteur du droit est contraint de choisir : ou bien il fonde sa décision sur une seule des normes constitutionnelles possibles ou bien il procède à une conciliation.

Freedom of choice allows everyone (older or younger, resident of staff member) to choose this or that attitude: to smoke or not to smoke; freedom of choice must go hand in hand with a sense of responsibility. One can thus grant priority to the rights of a group or to the rights of the individual or sometimes favour one over the other according to the circumstances. In any case, the person exercising a right has to make a choice: either to base the decision on only one of the possible constitutional norms or to make a compromise.
