Dans le cadre de ses recherches sur trois transformations du droit – l’extension des normes, l’assouplissement des formes et l’ébranlement des dogmes –, l’auteure propose une interprétation ambivalente : pathologie ou métamorphose. Il y aurait métamorphose si l’extension des espaces normatifs permettait une adaptation à la mondialisation, l’assouplissement du formalisme un ajustement à la complexité et si l’ébranlement des dogmes évitait la rigidité des dogmatismes. Ainsi pourrait se préparer une triple métamorphose : de l’ordre juridique, de ses interprétations et du rôle des juristes.

In her research on three transformations of the law – the extension of norms, the relaxation of forms and the shaking up of dogmas –, the author puts forward a two-sided interpretation : pathology or metamorphosis. It would be a case of metamorphosis if the extension of normative spaces enabled adaptation to globalization, a softening of formalism, adjustment to complexity and if the dismantling of dogmas were to get away from the rigidities of dogmatism. Then a triple metamorphosis could be expected in the area of the legal order, its interpretations and the role of lawmakers.
