RésuméAprès l’apparente éclipse du concept de loi naturelle, dans la suite de Vatican II, nous aurions affaire au retour en force de ce concept. Prenons quelques repères chronologiques : Humanae Vitae (Paul VI), Instruction Donum Vitae (pontificat de Jean-Paul II, 1987), Catéchisme de l’Église catholique, Veritatis Splendor, Evangelium Vitae, Fides et Ratio. Le concept de loi naturelle est devenu inaudible. Il ferait retour via la remise en valeur d’une certaine scolastique thomiste, qui devrait pouvoir correspondre à une source vivifiante. On constatera l’absence du thème de l’engagement de la liberté dans le récent document de la Commission théologique internationale. On pourrait proposer de revenir à la loi naturelle grâce au schéma rahnerien transcendantal/catégorial, mais les racines juives du christianisme sont aussi à explorer. Bref, c’est le soubassement conceptuel à la notion de loi naturelle qui fait souvent défaut, outre une difficulté à intégrer le caractère eschatologique de la morale dans ce concept.

Let us recall a few chronological landmarks: Humanae Vitae (Paul VI), Instruction Donum Vitae (pontificate of John-Paul II, 1987), Catechism of the Catholic Church, Veritatis Splendor, Evangelium Vitae, Fides et Ratio. The concept of natural law had become inaudible. It was to make its comeback via the revival of a certain Thomist scholasticism, which ought to operate as an invigorating source. In the recent document from the International Theological Commission, the theme of engagement of freedom is noticeable by its absence. We might suggest a return to natural law thanks to the Rahnerian transcendental/categorical schema, but the Jewish roots of Christianity must also be explored. In short, it is the conceptual foundation of the notion of natural law that often poses a problem, as well as the difficult integration to this concept of the eschatological nature of morals.
