Ministre de la justice de 1977 à 1981, Alain Peyrefitte avait, l’un des tout premiers à ce niveau de responsabilité politique, parfaitement compris la grande mutation qui s’était opérée dans ces années-là, avec la promotion de l’insécurité comme thème politique majeur et le profond fossé qui s’était creusé entre, d’un côté, le discours jusqu’alors dominant dans les cercles de pensée et traduit dans la législation pénale et, de l’autre côté, la sensibilité de l’opinion populaire. C’est ce qui l’a conduit, avec deux lois emblématiques, en 1978 et plus encore en 1981 («  Sécurité et Liberté ») à opérer une rupture radicale – et très clivante –, avec ce discours ; elles auront, dans l’ordre des idées et du droit, constitué un tournant majeur, même si leur portée concrète a été sapée par les aléas de notre histoire politique ; son action reste donc une référence à méditer.

Minister of Justice from 1977 to 1981, Alain Peyrefitte was one of the first to assume this level of political responsibility, and he understood perfectly the great change that had taken place in those years, with the promotion of insecurity as a major political theme and the deep gap that had opened up between, on the one hand, the discourse that had been dominant in circles of thought and translated into penal legislation, and, on the other hand, the sensitivity of popular opinion. This is what led him, with two emblematic laws, in 1978 and even more so in 1981 (“Security and Liberty”), to make a radical -and very divisive – break with this discourse ; they will have constituted a major turning point in the order of ideas and law, even if their concrete scope has been undermined by the hazards of our political history; his action therefore remains a reference to be meditated upon.
