Les consultations sur internet connaissent un réel développement favorisé par deux facteurs : dans une démarche de simplification du droit, elles apparaissent comme un substitut aux consultations institutionnelles en France et, en tant que consultations ouvertes, elles font l’objet d’une incitation forte au niveau international. Toutefois, envisager l’essor durable de ces consultations nécessite de répondre à deux interrogations qui prennent en compte les risques qu’elles présentent : quelles limites fixer à leur égard et quel droit leur appliquer ?

— Government use of online consultations — There has been considerable growth in the number of online consultations, for two reasons : as part of efforts to simplify laws, they offer an alternative to institutional consultations in France and, being open consultations, they are strongly encouraged at international level. Nevertheless, for the number of consultations to continue to grow in the long term, it will be necessary to answer two questions which take into account the potential risks : what should be the limits to online consultations and which law should apply ?
