L’article vise à montrer les logiques des relations qu’Esmein entretenait avec la référence à la République romaine. Il défend qu’il s’agit d’un terrain fructueux pour comprendre la spécificité du modèle républicain français. Il montre, autour du motif de la République romaine, que l’on peut être tout à fait républicain d’une part et tout à fait libéral d’autre part, une fois que l’on a défini la liberté comme non-domination plutôt que comme non-interférence.

The aim of this paper is to show what kinds of logic the connections between Esmein’s views and his reference to the Roman republic obey to. Esmein insists that the Roman republic offers fruitful ground to understand the peculiarity of the French republican model. Harping on the theme of the Roman republic, he intends to show that one can be both thoroughly republican and thoroughly liberal provided one has defined liberty as non-domination instead of as non-interference.
