Acteur de l’enquête pénale, l’assistant spécialisé en matière environnementale exerce ses fonctions au sein des pôles santé publique et environnement, et des pôles régionaux environnementaux. Intervenant dans le cadre défini par le Code de procédure pénale, il apporte un appui scientifique, technique et réglementaire aux magistrats du parquet ou de l’instruction. De l’analyse initiale d’une plainte et de la réglementation applicable, à la participation aux perquisitions et aux auditions, en passant par la recherche d’experts et le suivi de leurs travaux, l’assistant spécialisé peut intervenir à différents stades de l’enquête. Il est habilité à formuler des avis, rédiger des notes de synthèse ou d’analyse, qui pourront être versées au dossier de la procédure. Assurant une collaboration permanente avec les magistrats de la juridiction auprès de laquelle il est affecté, ses missions et sa compétence avant tout généraliste s’apparentent à celles d’un conseiller technique, aidant à la compréhension d’un contentieux à la fois spécialisé et diversifié.
