En dépit du consensus qui semble attaché au concept de transition écologique, un réexamen s’impose afin de comprendre son insuffisante mobilisation en droit et de renforcer sa performativité. L’usage actuel du concept laisse présager un sort identique à celui de développement durable, dont l’échec est patent. Il convient de réfléchir aux manières de surmonter les fragilités de cette notion, qu’on ne peut ignorer, et d’examiner ses potentialités pour édifier un concept opérant. Partageant certains ressorts des communs, dont elle pourrait appuyer le déploiement, la transition écologique conduirait alors effectivement vers la protection de l’environnement.

A new examination of the concept of ecological transition seems necessary, despite the consensus that seems attached to it, in order to understand its insufficient mobilization in law and to reinforce its performativity. The current use of the concept suggests that it is as useless as that of sustainable development, which failure is patent. It is important to think about ways to overcome the weaknesses of this notion, which cannot be ignored, and to examine its potential to build an effective concept. Sharing certain mechanisms of the commons, whose deployment it could support, the ecological transition would then effectively lead to the protection of the environment.
