La protection du patrimoine artistique national et le droit fiscal entretiennent des rapports étroits. La dation en paiement d’œuvre d’art est le mécanisme pensé en 1968 par le ministre Malraux afin de lutter efficacement contre la disparition des trésors nationaux à l’étranger. Les succès évidents de l’opération, renforcée par la très récente dation Picasso, ne doivent pas épuiser des débats sur une amélioration du mécanisme et de sa procédure.

The protection of national artistic heritage and tax law have a close relationship. The dation in payment of works of art is the mechanism conceived in 1968 by Minister Malraux in order to fight effectively against the disappearance of national treasures abroad. The obvious success of the operation, reinforced by the very recent Picasso dation, should not exhaust the debate on improving the mechanism and its procedure.
