Les tribunaux pour enfants ont été mis en place en 1912. Comprendre les raisons de leur instauration impose un retour sur la Belle Époque, ses bandes de jeunes qui inquiètent alors l’ensemble des pays industriels, à l’instar des Apaches à Paris. Ces bandes vivent du vol, du crime et de la prostitution. Dans un contexte où les jeunes constituent la question sociale, l’instauration des tribunaux et des juges pour enfants doit beaucoup au premier congrès international des tribunaux pour enfants qui s’est déroulé à Paris en 1911 et qui a constitué un moment fondateur. Alors que la délinquance et la criminalité juvénile connaissent une augmentation constante, les magistrats optent, lors de ce congrès, pour des mesures éducatives et non répressives. L’esprit de ce premier (et unique) congrès international a constitué la matrice de la protection de l’enfance en France.

The creation of Child tribunals as a response to “apache” and similar gangs of youthsTribunals for children were created in 1912. To understand the reasons for this, we need to study the “Belle Époque”, when gangs of young people worried the whole of the country in the same way as the “Apaches” in Paris. They lived by theft, crime and prostitution. The creation of children’s tribunals owes much to the first international congress of child tribunals which was held in Paris in 1911. Magistrates opted for educational measures at this congress rather than repression. The spirit of this international congress was the founding stone of child protection in France.
