N2  - Résumé Cet article revisite les approches qui tendent à assigner à l’analyse sociologique du droit un positionnement méthodologique dont la définition serait fondée sur une plus ou moins grande extériorité au droit. Ce positionnement « obligé » par rapport au droit relève selon nous de la croyance dans une nature ou une ontologie du droit, qui est de fait un obstacle à son analyse. C’est pourquoi il nous semble nécessaire de prôner une indifférenciation méthodologique qui permette éventuellement de faire apparaître les propriétés sociales du droit grâce à l’analyse sociologique, plutôt que de les présupposer; Abstract Methodological Question(s) : How to Handle Law as a Sociologist ? This article revisits common approaches that tend to assign a peculiar methodological stance to legal sociology in relationship to the externality to the law. The “necessity” to take a stand on this point is put into question, as it reveals a faith in the peculiar nature of law that is harmful to a proper sociological analysis. This is why we propose to defend a methodological neutrality towards law, in order to be able to eventually demonstrate, instead of presupposing, the social properties of law
