N1 - 7 N2 - In 2011 a Nigerian sex worker was for the first time granted refugee status on the basis of human trafficking. In this decision the group of victims who can claim asylum is defined not only according to nationality or persecution, but also according to “active emancipation.” Based on an analysis of the jurisprudence regarding human trafficking within the French National Court for Asylum, this article shows how, as the Court gained knowledge about this issue, suspicion shifted.
