<br/><br/> RésuméLa recherche d’une cause, l’imputation d’une faute, l’exigence d’une réparation, sont inhérentes à la souffrance. Même fruit du hasard, il faut qu’elle ait un sens. Cela fait du malheur une expérience complexe où se rencontrent le psychologique, le juridique et le sociologique. Problème de société : la société moderne le traite de façon ambiguë en termes de risque, de prévention, d’assurance et de revendication. Affaire de justice : les tribunaux sont sommés d’évaluer la souffrance et de permettre le deuil. Les victimes sont à la recherche d’un sens qui leur échappe, auquel chacun se dérobe en clivant responsabilité et culpabilité, droit et subjectivité.  Search for a cause, imputation of a fault, demand for a compensation are inherent to suffering which, even though the fruit of fate, must have a meaning. Misfortune is so a complex experience involving the psychological, the legal and the sociological. Problem of society : modern society deals with suffering in a ambiguous way, in terms of risk, of prevention, of guarantee and of demand. Problem of justice : courts are summoned to estimate the suffering and allow mourning. Victims are in search of a meaning that escapes them, from which each shies away by splitting responsibility and fault, law and subjectivity.
