<br/><br/> Tutelle réelle de l’embryon signifie protection effective sur la base du droit po-sitif en vigueur. L’étude cherche à montrer que l’embryon humain est un objet sous tutelle, établie par l’ordre juridique. Elle conteste que l’embryon soit titu-laire de droits subjectifs et donc qu’il puisse acquérir la qualification juridique de personne. La signification du terme de vie est conceptuellement différente au sens biologique et au sens juridique. Les codes civils européens assignent la capacité juridique au fœtus qui est né vivant. Avant cet instant, le système ju-ridique est en mesure d’accorder une protection à l’embryon toutefois diffé-rente de la norme qui protège la vie humaine de la personne déjà née. Bref, la protection de l’embryon est indépendante de sa qualification comme sujet.  Real Protection of the EmbryoReal guardianship of the embryo means protection on a legal basis. This study seeks to show that the human embryo is an object entitled to a legal safeguard that attributes to it human life as such. To ensure that the embryo has a right to defense does not mean it is to be considered as a subject of law or a person. The cycle that leads to the gradual development of human body is taken for granted in the biological sciences, but the legal significance is conceptually different. According to many European civil codes, “legal standing (i.e. legal personality) is acquired at the moment of birth”. The life before birth must be considered as an object of protection by the legal system and separate from the protection living individuals.
