Transphobia in France: The Inadequacy of the Law and Experiences of Discrimination

This article investigates an emerging issue in gender studies by examining the question of transidentities, and more precisely transphobia. I will first explore the French legal framework, in order to understand when the law does protect or does not protect individuals from transphobia. I will then investigate weakness of the law when it comes to transphobia, as is generally the case with anti-discrimination law. In a context in which empirical data show the widespread existence of transphobia, how can we explain that so few individuals lodge a legal complaint? Finally, I will put forward a more comprehensive definition of transphobic discrimination based in particular on people’s experiences, in order to convey the complexity of discrimination that a purely legal approach cannot grasp.
