Emerging Risk Prevention as a Litmus Test for the Precautionary Principle: The Case of Nanomaterials

Separate from labor law, the precautionary principle is established in the management of emergent occupational risks. Drawing from a series of monographs, this article describes uses of the law mobilized by employees and company management that precisely link precaution and prevention regarding technological applications related to nanomaterials. We analyze a convergence of these two laws that serve not only to inform about the risks, but also to manage them. Whereas the place of precaution in labor law is neglected legally or sociologically, we underscore the interdependence of labor and environmental laws for the prevention of new occupational risks.
