Jean-Pierre Winter explains his position in the debate concerning filiation and new family configurations. He is very troubled by the possibility for the legislator to “foreclose” the intervention of third parties in the biological conception of a child, when the parents-to-be are unable to procreate – especially for gay couples. Slavery’s “Black code” enlightens what would be violence by law. Winter doesn’t fear a risk of madness, but the impossibility, for the adult to be, of assuming filiation and parenthood.
