Councils of State represent a specific model of administrative court characterized by the combination within the same institution of the judicial function and the function of adviser of the executive branch. The judicialisation of the institution and its independence vis-à-vis the executive branch have guaranteed its survival in many countries. Today, the jurisprudence of the European Court of Human Rights is leading to a number of adjustments aiming to guarantee its ‘structural impartiality’.
