The relationship between innovation and intellectual property rights can be measured, from a legal point of view, in the light of legislation adopted at international, european and national level. It can thus be observed that, while the upheavals caused by the digital technology expansion have the effect of significantly reducing the data bases right in that they re-examine access to information and data, intellectual property rights, affirmed at the dawn of the twenty-first century as fundamental rights, remain ardently defended insofar as they condition, at least in part, the vitality of cultural industries and those based on technological innovation.
