Identification of the Employer - 2015.

25

The concepts of corporation and subordination have allowed judges to isolate the employer inside the complex organization of corporations. However, the evolution of the concept of corporation has brought about the collapse of jurisprudential constructions which served to establish the existence of an employment contract and consequently to identify the employer. This problem threatens the foundations of labor law. To remedy this we propose in this study a dynamic definition of the concept of employer and a plea for more recognition of economic dependence.
