The public and industrial healthcare field is particularly impacted by the difficulty in perceiving what is legally acceptable in lobbying practices and the illegitimate abuse of influence. In common parlance, it is the “conflicts of interest” concept that covers all the deviations noted in the course of lobbying. However, this notion is not included in the French Penal Code. Hence the problem: offences provided for under criminal law cannot be applied appropriately to managerial methods and influence strategies. In this situation, and faced with a constant risk of criminal proceedings, companies must be encouraged to regulate these practices themselves.
