N2  - RésuméLes biens immatériels sont supposés faire l’objet d’une protection juridique croissante. Le logiciel informatique devrait donc suivre ce mouvement. Mais une étude de la nature du logiciel et des différents modèles de l’industrie informatique nous indique que les stratégies mises en œuvre à partir de la propriété intellectuelle du logiciel ne sont opérantes techniquement que dans l’informatique personnelle. L’effet système créé par l’alliance du matériel et du logiciel rend peu utile la propriété intellectuelle du logiciel pour les grands systèmes ou les applications Internet. Codes JEL : O34, L63, L86; Intangible goods are increasingly protected by intellectual property. Therefore, software should follow this trend. Nevertheless a close study on the nature of software and the different models of the computer industry shows that strategies based upon software intellectual property are technically workable only in personal computing. The system effect produced by the combination of hardware and software obviates the intellectual property for mainframes or web applications. JEL codes: O34, L63, L86
