N2  - Le corps humain fait l’objet d’une attention de plus en plus soutenue de la part des législateurs africains. Le Sénégal ne fait pas exception à cette tendance. Dans les dernières décennies, de nombreux instruments juridiques y ont en effet été adoptés. A ainsi pris forme progressivement un droit de la bioéthique. Les dons d’organes et de tissus humains, la procréation médicalement assistée, les recherches biomédicales et d’autres innovations favorisées par les technosciences sont entrés ainsi dans les prévisions du législateur. Préfigurant une mutation corrélative du statut juridique du corps humain, la réception de cette règlementation gestante de la bioéthique offre une fois de plus l’occasion de méditer sur l’acte de légiférer dans un environnement social et économique qui assure à la fonction anthropologique du Droit une prévalence sur toute autre valeur; The human body is the subject of increasing attention from African lawmakers. Senegal is no exception to this trend. In recent decades, many legal instruments have in fact been adopted there. Thus gradually took shape a law of bioethics. Donations of human organs and tissues, medically assisted procreation, biomedical research and other innovations favored by technosciences have thus entered the legislator’s forecasts. Foreshadowing a correlative change in the legal status of the human body, the reception of this gestating regulation of bioethics once again offers the opportunity to meditate on the act of legislating in a social and economic environment which ensures the anthropological function of Law a prevalence over any other value
