La loi d’avenir pour l’agriculture, l’alimentation et la forêt, datée du 13 octobre 2014, introduit la notion d’agroécologie dans le droit. Cette intégration est remarquable dans le sens où, en sciences agronomiques, l’agroécologie représente une véritable révolution au regard du modèle de production agricole dominant, puisqu’elle prétend produire en s’appuyant sur les fonctionnalités des écosystèmes, et non en usant d’intrants pour lutter contre les contraintes environnementales. En caractérisant ce qu’il convient d’entendre par « agroécologie », la loi d’avenir comprend une palette d’outils de nature à inciter à une transition agroécologique. Mais, au-delà de ce premier état du droit, la notion d’agroécologie pourrait ouvrir la voie à une re-conception du droit qui régit les rapports qu’entretiennent l’environnement et l’agriculture. Et parce qu’elle recouvre un système complexe, la notion autorise, paradoxalement, une simplification du droit.

The law for the future of agriculture, food and forests of 13 October 2014 introduces the notion of agro-ecology in law. This integration is remarkable in that, in agricultural science, agro-ecology represents a revolution compared to the dominant agricultural production model, because it claims to produce by basing on the functionality of ecosystems, and not by using inputs to fight environmental constraints. By characterizing what should be understood by “agro-ecology”, the law includes a range of tools to encourage to an agro-ecological transition. But beyond this first state of law, the notion of agro-ecology should pave the way for a redesign of the law that governs the relationship between environment and agriculture. Because it covers a complex system, the notion allows paradoxically a simplification of the law.
